1. Acceptance of Terms

By accessing or using Content Whisper ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms apply to all users of the platform, including visitors, registered users, and paying subscribers.

2. Description of Service

Content Whisper is an AI-powered research and scriptwriting platform that helps content creators research topics, generate outlines, and produce scripts for video and podcast content. The Service includes access to YouTube research tools, AI-generated summaries, outline editors, and script generation features.

3. User Accounts

To access certain features of the Service, you must create an account using Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You must be at least 16 years old to create an account. By creating an account, you represent that you meet this age requirement.

4. Subscription Plans and Billing

Content Whisper offers the following subscription tiers:

• Starter (Free): Limited to 3 saved projects. Video format only.
• Creator ($19/month): Unlimited projects, all formats including Podcast, full Vault access.
• Pro ($49/month): Everything in Creator plus priority processing, API access, and dedicated support.

Subscriptions are billed monthly and renew automatically. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, or defamatory.
• Infringe on the intellectual property rights of others.
• Attempt to reverse engineer, decompile, or extract the source code of the platform.
• Use automated tools to scrape, crawl, or extract data from the platform.
• Circumvent usage limits or access controls.
• Resell or sublicense access to the Service without our written consent.

6. Intellectual Property

Your content: You retain full ownership of all scripts, outlines, and research data you create using the Service. By using the Service, you grant us a limited, non-exclusive license to store and process your content solely to provide the Service.

Our platform: The Content Whisper platform, including its design, code, and AI models, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without our express written permission.

7. AI-Generated Content

Content Whisper uses AI to assist in research summaries, outline generation, and script writing. You acknowledge that:

• AI-generated content may not always be accurate, complete, or suitable for your specific needs.
• You are responsible for reviewing, editing, and verifying all AI-generated content before publishing or distributing it.
• We do not guarantee the originality of AI-generated content, and you should verify that it does not infringe on third-party rights.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, Content Whisper shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service or other users. Upon termination, your right to use the Service will immediately cease.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be resolved through binding arbitration, except where prohibited by law.
